TERMS & CONDITIONS – JOMLAR TRAVEL CAR RENTAL

1. DRIVER AGE & LICENCE

• Drivers must be:

  • 20–65 years old for normal category.

  • 22–65 years old for luxury category.

• Must hold a full and valid national or international licence.

• Foreign licence in English accepted for max 3 months (subject to country).

• Probationary licence not accepted.

2. RENTAL PERIOD

The renter agrees to follow the rental period stated in the booking confirmation.

2.1 Jomlar Travel Responsibilities

• Maintain the vehicle according to manufacturer standards.

• Ensure the vehicle is roadworthy before rental.

• Ensure insurance coverage is valid.

• Provide a replacement vehicle (same class) in case of accident or breakdown.

2.2 Renter Responsibilities

• Keep vehicle and keys in good condition.

• Keep vehicle locked when unused; lost keys will incur charges.

• Use all security devices provided.

• Use correct fuel at all times.

• Responsible for any exterior damage including front, rear, upper, lower, sides, and undercarriage, regardless of liability reduction options.

• Cannot sell, rent, remove, or modify any part of the vehicle.

• Cannot grant legal rights over the vehicle to anyone.

• Cannot repair or service the vehicle without written permission.

• Must inform Jomlar Travel immediately of any defect or damage.

• Fully liable for damage or loss (including theft) during rental period.

• Must return the vehicle to the agreed location within operation hours.

• If returned after hours, renter’s liability continues until the next working day noon.

• Damage includes: glass, lights, tyres, rims, interior accessories.

• Cleaning fees apply if excessive cleaning is required.

• Ensure no personal belongings remain in the vehicle upon return.

• Renter must prepare Touch ‘n Go card; Jomlar Travel is not responsible for any claims or refunds related to the card.

3. RATES

• Minimum rental: 24 hours.

• Extra hours charged at 1/5 of daily rate per hour, up to 5 hours.

• Includes unlimited mileage, maintenance, liability protection, and third-party insurance.

• Rates in Ringgit Malaysia and may change without notice.

4. PAYMENT TERMS

4.1 Accepted Payment

• Visa / MasterCard (credit & debit) via online booking.

• Card must belong to the renter.

• Third-party cards and cash are not accepted.

• Jomlar Travel may refuse service if requirements are not met.

5. CANCELLATION & REFUND

• Non-refundable

6. EXTENSION & PENALTY

• Extensions, changes of pickup/return location, and adding drivers must be informed immediately.

• Failure to inform and pay will result in penalty.

7. OTHER CHARGES

Renter must pay:

• Rental and optional charges.

• Charges from non-compliance with any terms.

• Refuelling charge if fuel level is lower upon return.

• Fines, towing, clamping fees, admin fee RM20 if handled by Jomlar Travel.

• Full repair or replacement cost for damage or theft.
  Liability reduction may lower the cost if purchased.

• Loss of income if the vehicle cannot be rented (max 30 days).

• Charges related to vehicle seizure.

• Delivery and collection charges (set by Jomlar Travel).

• Legal fees for recovering payments.

• All taxes and applicable levies.

8. VEHICLE USAGE CONDITIONS

Vehicle cannot be used:

• By anyone giving false name, age, or address.

• By any unlisted or unauthorized driver.

• By probationary licence holders.

• For hire, illegal activities, off-road use, racing, testing, towing, or teaching someone to drive.

• Under the influence of alcohol, drugs, or banned substances.

• With passenger or baggage overload.

• For transporting restricted goods.

• For activities causing strong odours (durian, salted fish, religious items, etc.).

• To carry pets (not allowed).

9. TERMINATION OF AGREEMENT

Jomlar Travel may terminate the agreement if:

• Renter fails to make payment.

• Renter breaches any condition or term.

• Renter faces legal, business, or financial actions such as distress, liquidation, receivership, or unsatisfied judgment after 30 days.

10. GOVERNING LAW

This agreement follows Malaysian law.
Disputes will be handled under Malaysian court jurisdiction.
If any clause becomes invalid, the remaining terms remain effective.
